Transaction & Intermediary Terms

Article 1 (Purpose)

These Terms govern the rights, obligations, and responsibilities of the Company, users, and business partners in connection with the order, reservation, and delivery intermediary services (“Intermediary Services”) provided by EKCOW (the “Company”), including matters related to e‑commerce and online marketplace intermediary regulations.

Intermediary Services include, without limitation, placement and acceptance of orders, confirmation, modification, and cancellation of reservations, and delivery (or delivery booking) with businesses such as restaurants, lodging, and massage establishments.

Article 2 (Definitions)

Article 3 (Scope of application)

These Terms apply to the following:

For Overseas Businesses, local laws of the country or region where the business is located may prevail over these Terms where mandatory. The Company applies these Terms to the extent consistent with such laws. Disputes between users and Overseas Businesses may be subject to local courts and law.

Article 4 (Order service)

4.1 Request and acceptance

A contract is formed when the business accepts the user’s order. If acceptance is not possible due to the business’s circumstances, the Company will notify the user and, where payment has been made, take refunds or other necessary measures.

4.2 Cancellation and refunds

Cancellation and refund conditions follow the business’s policies and the Act on the Consumer Protection in Electronic Commerce (in Korea) or applicable local consumer protection laws (outside Korea). The Company supports cancellation and refund procedures as an intermediary.

4.3 Scope of liability

The business is principally responsible for provision, quality, delay, and damages relating to ordered goods or services. The Company is responsible only for providing the Intermediary Services and, regarding performance of contracts between businesses and users, within the scope of an intermediary’s liability.

4.4 Payment methods

Order and reservation payments may be made using methods configured by the business (on‑site, bank transfer, QR payment, etc.). The Company acts as an intermediary, not a payment processor, and supports relay of order/reservation information and related procedures.

Article 5 (Reservation service)

5.1 Confirmation

A reservation is formed when confirmed by the business. If the business rejects or changes a reservation, the Company will notify the user and support cancellation and refunds where payment has been made.

5.2 No‑show and cancellation

If the user does not attend at the reserved time (no‑show) or cancels, the business’s no‑show and cancellation policies (fees, penalties, etc.) may apply. For Overseas Businesses, local business policies apply.

5.3 Changes

Changes to date, time, party size, menu, etc., follow the business’s policies; the Company supports relaying change requests and coordination with the business.

Article 6 (Delivery service)

6.1 Delivery intermediary

The Company intermediates delivery bookings and orders among users, businesses, and delivery personnel. Actual delivery may be performed by the business or a third‑party carrier; the Company provides intermediary services only.

6.2 Delays and incidents

For delays, loss, or accidents, the Company acts only within the scope of an intermediary’s liability; damages attributable to the performing carrier or business are borne by them. Users may seek compensation or refunds according to business or carrier policies and local laws.

6.3 Delivery tracking

Delivery status (accepted, preparing, in transit, completed, etc.) may be relayed and displayed from information provided by the business or carrier. The Company is responsible only within the scope of an intermediary for accuracy or delays.

Article 6‑2 (Dine‑in, tables, and QR)

Users may place orders or payments via in‑store tables or QR codes; the Company intermediates such requests to the business. Fulfillment and payment are the business’s responsibility.

Article 6‑3 (PostChat and transaction reviews)

Post‑based 1:1 chat (PostChat) and transaction reviews linked to orders, reservations, delivery, or dine‑in facilitate communication and feedback between users and businesses. The Company operates relay, reporting, and enforcement policies; parties are responsible for content truthfulness and contract performance.

Article 6‑4 (Coupons and web guests)

Article 7 (Online marketplace intermediary / e‑commerce)

The Company may qualify as an online marketplace intermediary under e‑commerce law; the actual sale contract is between the user and the business. The Company is not a party to the transaction, and specific obligations regarding supply, refunds, and withdrawal rest with the business. The Company may operate policies and procedures as platform operator to protect users where necessary.

Korean consumer protection laws apply to domestic businesses; relevant laws of the country or region may apply to Overseas Businesses.

Article 8 (Changes to these Terms)

The Company may change these Terms when necessary. Changes take effect upon notice on the service home screen or in the app. If you do not agree to the changes, you may stop using the Intermediary Services; continued use after change constitutes acceptance.

Article 9 (Governing law and jurisdiction)

These Terms are governed by the laws of the Republic of Korea, without prejudice to mandatory laws of another country or region applicable to transactions with Overseas Businesses. Disputes between the Company and users shall be brought before courts of competent jurisdiction under the Civil Procedure Act.

Supplementary provisions

These Terms take effect on 2026-07-30.
